offbrands are 100% legal as you cannot copyright a "species".
offbrands of any form are never illegal unless they take a trademarked name and use it for commercial profit, not counting "virtual currency" like dA points. off-branders do not typically use the name of the species they're offbranding.
in addition, most species names are not trademarked. the only trademarked species names i know of are sushi dogs and cinnadogs, but that still does not stop anyone from making their own character of the species so long as they don't sell it with the name attached.
if you ask any serious species owner (ex. one who has trademarked their name), they will tell you the same thing.
creating a species and claiming it to be "closed" does not actually have any sort of legal value.

Of course you can make off brand species.
But to be honest just create your own creature designs. Its rude to the original creators and lazy because you were not able to come up with the concept yourself.

The morality and ethicality of offbrands is person to person. This user obviously didn't make them out of spite (They've been inactive for ages), and just because someone makes offbrands does absolutely NOT mean that they are lazy.
Their designs are amazing, like even people who dislike offbrands have offered on them and want them.
That isn't lazy just because they used the same anatomy/traits/concept as a CS- plus, who knows what their main is? For all we know they have tons of extremely unique and well made species of their own.

Yes true. I recently started kinda asking people about their view points on this and have decided that it's just person to person. As alot of other things in our current year are and that's ok.
I had actually ment to delete my comment on this page cause it was written by a raging overly dramatic teen that is me. But I couldn't find the deviant art person again.
And you can accept this next part or think I'm just lying. But to the creator sorry for my ignorance and rude words. They were not valid. I will not comment something like that again
For me personally I just will always not own closed Species unless I get them from the creators and places like that. Just cause that's how I wanna be. But it's tottaly fine for people to do these things.
Plus open Species are much better so I usually stick to those.
